A significant victory occurred in California today after a ruling took place that will officially put an end to the debate of whether or not deliveries of cannabis are legal throughout the state. The beginning of this year Proposition 64 which legalized a retail market for adults in the state took effect. While Proposition 64 allowed for municipalities and local governments to ban the operation of cultivation centers, extraction facilities, and dispensaries within their area this ruling will override local laws.
Is This Ruling Unjust?
Many have said that this is unjust as it goes against Proposition 64’s wishes of allowing local municipalities to take their own direction when it comes to whether or not cannabis industry can exist in their region. Many prohibitionists also say that this ruling will undermine the authority oflocal governments and could potentially cause an increase in crime.
Why the Ruling?
This ruling came to be after deliveries were put on debate by outspoken voices of law enforcement officials in anti-pot locales who insisted they could arrest anyone making deliveries of cannabis in their city or town despite whether or not the delivery driver was licensed for operation in the state. This ruling will officially go in to place in 30 days as long asit does not receive objection by the California Office of Administrative Law.
The End of the Debate
The Bureau of Cannabis Control has maintained their position since the beginning that Proposition 64 explicitly allows for cannabis deliveries in all townships, cities, and municipalities despite local cannabis industry related laws. This new ruling which was concluded on December 7th by California regulators will finally concluding this debate.
